Acceptance of terms

We may update and revise these Terms of Use at any time. The latest version is always available through the “Terms of Use” link at the bottom of our web pages; when the terms are updated, we revise the version number and effective date at the top of this page. Your continued use of the Services after a new version is published constitutes acceptance of it.

Description of the Services

Through our websites, mobile apps, monitoring platform, and other online assets, we provide you with a range of resources related to photovoltaic (PV) energy storage products, including product information, technical documentation, download areas, customer support, warranty registration, and system monitoring portals (collectively, the “Services”). The Services, together with any updates, enhancements, new features (including any artificial intelligence features), and newly added online assets, are subject to these Terms of Use.

Personal and non-commercial use limitation

Unless otherwise specified, the Services are for your personal and non-commercial use only, or for the lawful use of business and institutional customers in connection with BestSolar products they have purchased. Without our prior written authorization, you may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Services.

Privacy and protection of personal information

For disclosures about the collection and use of personal data, including data processed in connection with artificial intelligence features, please see our Privacy Statement.

Content

All content included in or obtainable through the Services — such as text, graphics, logos, icons, images, audio, digital downloads, data compilations, software, and documentation, whether created by humans or generated or assisted by artificial intelligence — is the proprietary property of Best Energy Technology Co., Ltd. or its content suppliers and is protected by trade dress, copyright, trademark, patent, and other intellectual property and unfair competition laws (the “Content”). All rights not expressly granted to you under these terms are reserved by us or our licensors.

AI-generated content and AI features

(a) AI-generated content. Portions of the Content available through the Services — such as articles, product descriptions, summaries, illustrations, and translations — may be created or assisted by generative artificial intelligence (“AI”) technologies (“AI-Generated Content”).

(b) Labeling. Where required by applicable law, we identify AI-Generated Content by means of a visible notice displayed on or near the relevant content and/or identifying information embedded in the content’s metadata. You may not delete, alter, forge, or conceal any such label, and you may not misrepresent AI-Generated Content as human-created.

(c) Accuracy; no professional advice. We make reasonable efforts to review AI-Generated Content before publication; nevertheless, it may contain inaccuracies, omissions, or errors, and is provided for general information only. It does not constitute engineering, electrical, safety, legal, financial, or other professional advice. Before making any decision relating to the selection, installation, configuration, operation, or maintenance of an energy storage system, you must rely on the official product documentation and the advice of qualified professionals, not on AI-Generated Content.

(d) AI Features. We may introduce interactive AI-powered features, such as an intelligent customer support assistant (“AI Features”). When AI Features become available: (1) you will be clearly informed that you are interacting with an AI system and not a human; (2) supplemental terms may apply and will be presented to you at or before first use; and (3) these Terms of Use, including this section, will apply to your use of them.

(e) Outputs are not binding statements. Responses generated by AI Features (“Outputs”) are produced automatically and may be inaccurate, incomplete, or outdated. Outputs do not constitute official statements, commitments, warranties, or contractual offers. Warranty coverage, service commitments, pricing, and technical confirmations are valid only when set out in official BestSolar documentation or confirmed by authorized BestSolar personnel.

(f) Your inputs; acceptable use of AI Features. You are responsible for the content you submit to AI Features and warrant that it does not infringe any third-party rights. You may not use AI Features to: (1) generate, request, or disseminate unlawful, infringing, or harmful content; (2) attempt to extract, reverse engineer, or discover the underlying models, system prompts, or training data, or circumvent safety measures; (3) submit another person’s personal data without lawful authority; or (4) send automated, bulk, or excessive queries that interfere with the operation of the Services.

Software and firmware

Any software, firmware, or mobile application that can be downloaded from the Services or that is embedded in BestSolar products (the “Software”) is a copyrighted work of Best Energy Technology Co., Ltd. and/or its suppliers. Use of the Software is governed by the accompanying end-user license agreement, if any (the “License Agreement”). Any reproduction or redistribution that does not comply with the License Agreement is expressly prohibited by law and may result in severe civil and criminal penalties.

Except as warranted in the License Agreement or applicable warranty terms, we disclaim all warranties and conditions with regard to the Software, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Documentation

Documentation provided through the Services — such as datasheets, installation manuals, white papers, FAQs, and product specifications — is licensed to you on the following conditions: (1) all copies must include the copyright notice and this license notice; (2) it may be used only for informational and non-commercial or personal purposes, and may not be copied or posted to any networked computer or broadcast in any media; and (3) no modifications may be made to any documentation.

The foregoing does not include the design or layout of our websites. Elements of our websites are protected by trade dress, trademark, unfair competition, and other laws, and may not be copied or imitated in whole or in part. The documentation and related graphics may contain technical inaccuracies or typographical errors, and the information is periodically updated; we and/or our suppliers may make improvements or changes to the products and/or programs described at any time.

Limitation of liability

In no event shall Best Energy Technology Co., Ltd. and/or its suppliers be liable for any special, indirect, or consequential damages, or any damages arising from loss of use, data, or profits, arising out of or in connection with the use or inability to use the Software, documentation, AI-Generated Content, AI Features, the provision of or failure to provide the Services, or information obtained through the Services, whether based on contract, negligence, or other tort. In particular, to the maximum extent permitted by applicable law, we shall not be liable for any loss arising from your reliance on AI-Generated Content or Outputs in breach of the “AI-generated content and AI features” section above.

The above limitation does not apply to the extent prohibited by applicable law, and does not limit our liability under the warranty terms applicable to the products you have purchased.

Member accounts, passwords, and security

If the Services require you to open an account — such as the BestSolar monitoring portal or an installer account — you must provide current, complete, and accurate information as prompted by the registration form and set a username and password. You are solely responsible for maintaining the confidentiality of your password and account and for all activity that occurs under your account, and you must notify us immediately of any unauthorized use or security breach. You may not use another person’s account without the account holder’s permission.

Prohibited unlawful or improper use

As a condition of using the Services, you may not use them for any purpose that is unlawful or prohibited by these terms. You may not use the Services in any way that could damage, disable, overburden, or impair any of our servers or the networks connected to them, nor attempt to gain unauthorized access to any service, account, or system through hacking, password mining, or other means. You may not use the Services to:

• transmit any unsolicited or unauthorized advertising, promotional materials, spam, chain letters, or other forms of solicitation;
• defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others;
• upload, post, or transmit content that infringes any patent, trademark, trade secret, copyright, or other proprietary right;
• upload files that contain viruses, Trojan horses, worms, time bombs, corrupted files, or similar programs;
• tamper with, reverse engineer, decompile, or attempt to derive the source code of any Software, except as expressly permitted by applicable law;
• attempt to modify, alter, or interfere with the firmware, monitoring data, or safety controls of any BestSolar energy storage product in a way that compromises product safety or performance;
• delete, alter, forge, or conceal labels identifying AI-Generated Content, or misrepresent AI-Generated Content as human-created; or
• violate any applicable laws or regulations, including but not limited to those governing product safety, export controls, electrical installation, and artificial intelligence.

Materials you provide to or post on the Services

We do not claim ownership of the materials you provide — including feedback, suggestions, and inputs submitted to AI Features — or post, upload, or submit to the Services (the “Submissions”). However, by submitting them, you grant us and our affiliates and necessary sublicensees a license to use the Submission in our business operations, including the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat it. For the avoidance of doubt, the use of inputs submitted to AI Features for AI model training is governed by the “Artificial intelligence” section of our Privacy Statement.

No compensation will be paid for such use of a Submission. We are under no obligation to publish or use any Submission and may remove it at any time at our sole discretion. You warrant that you own or control all rights necessary to your Submission.

Links to third-party sites

The Services may contain links to third-party sites. The linked sites are not under our control, and we are not responsible for their content, any links contained in them, or any updates to them. These links are provided for your convenience only, and the inclusion of any link does not imply our endorsement of that site.

Governing law and dispute resolution

(a) Who you are contracting with. Unless a separate written agreement identifies a different BestSolar entity, the Services described in these Terms of Use are provided by Best Energy Technology Co., Ltd., a company incorporated in the Hong Kong Special Administrative Region of the People’s Republic of China.

(b) Separate agreements prevail. If you have entered into a separate written agreement with us, one of our affiliates, or an authorized distributor — such as a purchase, supply, distribution, EPC, or service agreement — the governing law, dispute resolution, and liability provisions of that agreement prevail over this section for any matter arising under it, and the contracting entity named in that agreement is your counterparty. These Terms of Use govern only your use of the Services, meaning our websites, apps, monitoring platform, and related online assets.

(c) Governing law by region. Except as provided in (b), the law and forum that apply to these Terms of Use depend on where you live or, if you are a business, where your principal place of business is located:

(d) Mandatory local law. Nothing in these Terms of Use limits any right you have under the mandatory consumer protection law of your country of habitual residence that cannot be waived by agreement. Where such law gives you the right to bring proceedings in your local courts, or entitles you to remedies that these terms would otherwise exclude, that law prevails over this section to the extent of the conflict.

(e) Choice of law conventions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms of Use.
